What Would Yes on IL26-001 Mean?

Carefully crafted language passed by the 2025 Legislature would be eliminated including changes made to protect parent and student rights while making sure Washington’s parent access laws are consistent with federal and state laws.

This initiative does not rise to the level of good law: It’s neither clear nor well-considered, creating confusion and potential for error—raising concerns that protected medical information could be disclosed in error and students facing violence, sexual abuse, bullying, depression or other health challenges may be less likely to seek help from trusted school counselors.

What Would Yes on IL26-638 Mean?

All girls wanting to participate in sports would be required to get a statement signed by a health care provider verifying their biological sex, relying on the student’s reproductive anatomy, genetic makeup, or normal endogenously produced testosterone levels.

All of this to prevent a hypothetical scenario in which a trans girl, one of just a handful in Washington state, might someday pole vault higher, swim faster or win a race due to their status. Could this happen? Perhaps, but the odds are extremely low. Violating the personal privacy of an estimated 200,000 Washington girl athletes is not a solution.
